Bill 36 explained in plain English

Adds a new Part II.1 creating a clean energy credit system where environmental attributes from electricity generation can be registered, transferred, and retired through a registry managed by the IESO. The Minister can make regulations governing the system. Amendments also clarify the Minister's title and add registry rules as a matter under the Minister's discretion.

Removes the condition that salaries of Members of the Legislative Assembly would be frozen in the second fiscal year after the province's total revenues exceed its total expenses. Members' salaries will now continue to be adjusted according to regular indexing rules.

Updates rules for calculating the salaries of members of the Assembly to reference section 61 of the Legislative Assembly Act. Repeals and replaces provisions describing how annual salaries are determined.

Doubles the amount of increment payments to eligible persons during 2023 (January 1 to December 31, 2023). The doubled amount is two times the amount otherwise payable under the Act.

Clarifies that collective agreements are documents that create and support pension plans in three circumstances: when the plan is established by the agreement, when the agreement incorporates the plan by reference, or when the plan terms are set out in the agreement. Requires all pension plans to have written funding and governance policies. Provides transition rules for existing and new plans with target benefits.

Updates rules made by the Ontario Securities Commission to allow documents required to be delivered under the Act to be made available in alternative ways (such as online) instead of physical delivery. Documents made available this way are deemed received on the date specified in the rules. Expands the scope of Commission rule-making to cover 'filing, delivery, distribution or making available' instead of just 'filing or delivery'.

Modifies the Ontario production services tax credit for film and television production. Creates different eligibility conditions for expenditures on leasing real property incurred after November 14, 2022, when the landlord is not ordinarily in the business of leasing such property. Limits the total amount of such leasing expenditures that can be claimed in a year to the lesser of the calculated amount or 5 per cent of total qualifying production expenditures.
